Therefore, when a buyer confirms their order on the site, they are fully accepting these General Terms and Conditions of Sale. Final acceptance occurs when the customer enters their credit card details, triggering payment and validating the transaction, or when sending a check or making a bank transfer. In case of online payment by credit card, an order confirmation is sent to the customer by email, summarizing the order information and assigning a number to it. In the event of an error in the customer’s input of ordered items and/or recipient details, Gdispro cannot be held responsible for any failure to deliver the products.
No cancellation or modification of an order, except under the legal right of withdrawal, can occur without prior written consent from both parties, or the granting of a compensatory indemnity to Gdispro. No new order will be executed if the customer is in default on the due date unless exclusively accepted with cash on delivery.
For most items presented on the site, the average processing and shipping time for orders is approximately 72 hours (Note: allow one week for heavy or bulky items shipped by carrier). This applies when payment is made online by credit card and does not constitute an obligation regarding delivery time. For check payments, the processing time of the order will be extended by the check’s clearance time. While we always strive to ensure the best availability of the products offered by our suppliers, some items, particularly promotional items with high turnover, may be delayed due to restocking or temporary out-of-stock situations with our suppliers. If one or more products in the order are unavailable for an unusually long period, the customer will be informed by email. They will then have the option to wait based on the new delivery time communicated, request a replacement for out-of-stock items, or cancel the order and request a refund, which will be processed within 30 days from the payment date.
If the shipment is delayed due to the buyer’s actions, the goods will be stored, handled, and stored at the buyer’s expense and risk, and Gdispro accepts no responsibility. These provisions do not affect the buyer’s payment obligations for the goods. After 15 days, Gdispro may consider the order canceled and the sale unilaterally terminated by the buyer. Delivery times begin from the date the order is received. Delays cannot justify canceling the order. Once notified by the buyer of any defects, and subject to proof, the Gdispro site must, after verification, repair the defective products and take all necessary actions to fulfill its obligations, while reserving the right to make any necessary modifications. Work will be carried out at the company's workshops after the buyer returns the defective products for repair. The cost of transport related to the repair and return is the responsibility of the buyer. Gdispro’s liability is strictly limited to the conditions defined above, and it is expressly agreed that the company is not liable for any compensation.
Gdispro agrees to remedy any operating defects resulting from a defect in design, materials, or execution, within the scope defined below. Gdispro’s obligation does not apply in cases of defects noticed after repairs by third-party services or unauthorized interventions on the goods. The warranty does not apply to elements affected by fortuitous events or force majeure, or to replacement or repairs resulting from normal wear and tear or accidents due to negligence (lack of supervision, maintenance, or use).
Goods travel at the recipient's risk and are sold, taken, and payable at Andrezieux – Rhone Alpes. It is the recipient’s responsibility to check the condition and weight of the parcels upon arrival and, if necessary, to make any useful reservations with the carrier within 48 hours, in writing with acknowledgment of receipt. In the case of damage occurring during transport, when the goods are not delivered by us, it is the recipient’s responsibility to pursue any claims against the carrier, in accordance with Article L 133-3 of the Commercial Code.
